By accessing or using the GustVPN service, applications, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and GustVPN ("we," "us," or "our").

2. Description of Service

GustVPN provides a virtual private network (VPN) service that encrypts your internet traffic and routes it through our servers. The Service is designed to enhance your online privacy, security, and ability to access internet resources.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

You must be at least 16 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

4. Subscription and Payment

4.1 Plans and Pricing

The Service is offered through various subscription plans, including free trial and paid tiers. Subscriptions are managed exclusively through our mobile applications (iOS and Android). We reserve the right to change pricing with 30 days' notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed through the Apple App Store or Google Play Store. All payment processing is handled by the respective platform. You agree to pay all fees associated with your subscription plan in accordance with the platform's billing terms.

4.3 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. Please contact the relevant platform for refund inquiries.

4.4 Cancellation

You may cancel your subscription at any time through your device's subscription management settings (App Store or Google Play). Upon cancellation, your access will continue until the end of the current billing period.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use the Service to:

• Engage in any activity that violates applicable local, state, national, or international law or regulation
• Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Distribute malware, viruses, or any other malicious code
• Conduct or participate in denial-of-service attacks or other disruptive activities
• Send unsolicited bulk messages (spam) or conduct phishing activities
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to other computer systems or networks
• Engage in any activity that could damage, disable, or impair the Service
• Share your account credentials with third parties or allow others to use your account beyond permitted device limits

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you are violating these terms.

6. Device Limits

Each subscription plan specifies a maximum number of simultaneous device connections. You agree to abide by the device limits of your selected plan. Exceeding these limits may result in connection restrictions or account suspension.

7. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content, is owned by GustVPN and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer or attempt to extract source code from the Service
• Use the Service's branding or trademarks without prior written consent

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee any specific connection speed, uptime, or server availability. VPN connections may be affected by factors beyond our control, including network conditions, ISP policies, and government regulations.

While we use industry-standard encryption and security measures, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUSTVPN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on or through the Service
• Any unauthorized access to or alteration of your data
• Any other matter relating to the Service

Our total cumulative liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless GustVPN, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you transmit through the Service

12. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any interruption or cessation of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GustVPN operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GustVPN regarding the use of the Service and supersede all prior agreements and understandings.
